Hello and welcome to the Loan Factory Terms & Conditions. Our Privacy Policy explains what personal information we collect and how it’s used and shared, and our Acceptable Use Policy outlines some of your responsibilities when using the Services.
By using or accessing the Services, you’re agreeing to these Terms, our Privacy Policy and our Acceptable Use Policy (collectively, this “Agreement”). If you don’t agree to all the terms in this Agreement, you may not use or access the Services. This Agreement covers automatic subscription renewals, warranty disclaimers, limitations of liability, resolution of disputes by arbitration and a class action waiver.

Any use or access by anyone under the age of 18 is not allowed. If you open an account on behalf of a company, organization, or other entity, then you represent that you have the authority to bind that entity to this Agreement.
The Services let you submit content such as loan applications, documents, messages, and other materials. You retain ownership of any intellectual property rights that you hold in that content.
When you submit content to the Services, you grant Loan Factory a worldwide license to use, host, store, and process that content solely to operate, provide, and improve the Services for you.
What information we collect and how we use and share it is described in our Privacy Policy. By using the Services, you agree that Loan Factory can use such data in accordance with that policy.
All right, title, and interest in and to the Services are and will remain the exclusive property of Loan Factory and its licensors. The Services are protected by copyright, trademark, and other laws of the United States and foreign countries.
These Terms do not grant you any right to use the Loan Factory name, trademarks, logos, domain names, or other distinctive brand features without our prior written consent.
You agree not to misuse the Services or help anyone else do so. This includes not attempting to probe, scan, or test the vulnerability of any system or network, and not accessing or searching the Services by any means other than our publicly supported interfaces.
You may not send altered, deceptive, or false source-identifying information, or interfere with or disrupt the Services or servers or networks connected to the Services.
You may stop using the Services at any time. We reserve the right to suspend or terminate your access to the Services, with or without notice, if you violate this Agreement or if we reasonably believe that your conduct creates liability for us or other users.
Upon termination, all provisions that by their nature should survive will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
Some Services may be offered on a subscription basis. Unless you cancel before the end of the current period, your subscription will automatically renew and you authorize us to collect the then-applicable fee using your payment method on file.
The Services are provided on an "as is" and "as available" basis. Loan Factory makes no warranties, express or implied, regarding the reliability, availability, timeliness, quality, or accuracy of the Services.
To the fullest extent permitted by law, Loan Factory disclaims all warranties, whether express, implied, statutory or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Rates and estimates shown are not a commitment to lend.
To the maximum extent permitted by applicable law, Loan Factory and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
In no event will Loan Factory's aggregate liability for all claims relating to the Services exceed the greater of one hundred U.S. dollars ($100) or the amounts paid by you to Loan Factory for use of the Services during the prior twelve months.
You and Loan Factory agree to resolve any disputes arising out of or relating to this Agreement or the Services through final and binding arbitration, except as set forth below. This does not prevent either party from seeking injunctive or equitable relief for infringement of intellectual property rights.
You and Loan Factory agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Unless both parties agree otherwise, no arbitrator may consolidate more than one person's claims.
This Agreement and any action related thereto will be governed by the laws of the State of California, without regard to its conflict of laws provisions. Any dispute not subject to arbitration will be brought exclusively in the courts located in California.
We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision is material, we will provide reasonable notice prior to the new terms taking effect. By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms.
